Mandatory-Minimums and Drug Trafficking

Idaho has Mandatory-Minimum Sentencing for Drug Trafficking Charges. This means that if you are found guilty or plead guilty to Drug Trafficking, YOU WILL GO TO PRISON for at least the amount of time required for the type of drug and amount that you are in possession of. See tables below for the Mandatory-Minimum required depending on the amount and type of substance.

1 Year Mandatory-Minimum

5 - 24 Pounds
50 - 99 Plants

3 Years Mandatory-Minimum
$10,000

5+ Pounds
100+ Plants

5 Years Mandatory-Minimum
$15,000

Although the above represents the Mandatory-Minimum Sentence you can receive for trafficking in Marijuana, the Maximum penalty is 15 years /$50,000

COCAINE: (Idaho Code 37-2732B(2))

200 - 399 grams

5 Years Mandatory-Minimum
